Welcome to the website of South Shore Eye Associates("we," "us," "our," or "the Practice"), located at 670 Depot St., Unit 8, North Easton, MA 02356. These Terms of Service ("Terms") govern your access to and use of our website at southshoreeye.com , as well as the optometry and retail eyewear services we provide (collectively, the "Services").

By accessing or using our Services — whether in person, by phone, or through our website — you ("you," "your," or "Patient") agree to be bound by these Terms. If you do not agree, please do not access or use our Services.


01 Eligibility

To receive Services from South Shore Eye Associates, you must:

  • Be at least 18 years of age, or be accompanied by a parent or legal guardian if under 18
  • Have the legal capacity to enter into a binding agreement under Massachusetts law
  • Provide accurate and complete information when registering as a patient or booking an appointment

By receiving our Services, you confirm that you meet these eligibility requirements. Parents or legal guardians who schedule or consent to Services on behalf of a minor accept these Terms on the minor's behalf.


02 Service Provision

South Shore Eye Associates provides comprehensive optometric care and retail eyewear services, including but not limited to:

  • Comprehensive eye examinations
  • Contact lens exams and fittings
  • Pediatric eye care
  • Eyeglass frame and lens selection and dispensing
  • Screening for glaucoma, macular degeneration, diabetic eye disease, and other ocular conditions

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time. Clinical decisions — including the scope of examination, recommended treatment, and whether to accept or continue a patient relationship — remain at the sole professional discretion of our licensed optometrists. Nothing in these Terms limits our clinicians' exercise of independent professional judgment.


03 Appointments & Cancellations

Appointments may be scheduled by phone at (508) 238-8460 , by email, or through our website. By scheduling an appointment, you agree to:

  • Provide accurate contact and insurance information at the time of booking
  • Arrive on time for your scheduled appointment
  • Notify us as soon as possible — ideally at least 24 hours in advance — if you need to cancel or reschedule
  • Bring your current insurance card and any relevant medical history or prescription records

Repeated no-shows or late cancellations may affect our ability to schedule future appointments. We will make reasonable efforts to reach you to confirm appointments before your visit.


04 Payment & Pricing

All prices for eye exams, eyewear, and contact lenses are subject to change without notice. Payment is due at the time services are rendered or products are dispensed. We accept:

  • Cash
  • Visa, Mastercard, American Express, and Discover
  • Personal checks
  • Flexible Spending Accounts (FSA) and Health Savings Accounts (HSA)
  • Financing (subject to approval — ask our team for current financing options)

We accept major vision and health insurance plans. It is your responsibility to verify your specific coverage with your insurer prior to your visit. We will assist in submitting claims to your insurance carrier, but we cannot guarantee coverage or reimbursement. Any amounts not covered by insurance remain your responsibility.

Balances that remain unpaid after 30 days may be subject to a finance charge or referred to a collection agency. If you have questions about a balance or your insurance coverage, please contact us before your appointment.


05 Eyewear & Retail Products

All eyewear and contact lens orders are placed based on the prescription provided at your examination. By placing an order, you:

  • Confirm that the prescription being filled is current and valid
  • Acknowledge that custom-made optical products (prescription lenses, frames with custom lenses) are non-refundable once fabrication has begun, unless there is a verified laboratory error
  • Agree to pick up completed eyewear within 60 days of notification; unclaimed orders after 60 days may be restocked

We stand behind the quality of our products. If you experience a defect or fitting issue with eyewear dispensed by our practice, please contact us within 30 days of receipt and we will work to resolve the issue appropriately. Adjustments to frames are complimentary for eyewear purchased from our optical dispensary.


06 Prescriptions & Medical Records

You have the right to receive a copy of your eyeglass or contact lens prescription at the conclusion of your examination, as required by federal law. Prescriptions are valid for the period specified by your optometrist or as required by Massachusetts law.

Your medical records are maintained confidentially in accordance with our Privacy Policy and applicable state and federal law, including HIPAA. Requests for records should be made in writing to our office. A fee may apply for copies of records, consistent with Massachusetts regulations.


07 Intellectual Property Rights

All content on our website — including text, images, graphics, logos, and design — is the property of South Shore Eye Associates or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on our website without our prior written permission.

Any feedback, suggestions, or ideas you submit to us may be used by South Shore Eye Associates without restriction or compensation to you.


08 User Conduct

When using our website or communicating with our practice, you agree not to:

  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to any part of our website or systems
  • Use our website for any unlawful purpose or in violation of any applicable regulations
  • Transmit any harmful, offensive, or disruptive content via our contact forms or email
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to deny Services to any individual who engages in abusive, threatening, or disruptive behavior toward our staff or other patients.


09 Limitation of Liability

To the maximum extent permitted by applicable law, South Shore Eye Associates and its licensed practitioners, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services or website, including but not limited to loss of data, revenue, or goodwill.

Nothing in these Terms limits our liability for gross negligence, willful misconduct, or professional malpractice claims governed by Massachusetts law. Our total liability for any direct damages shall not exceed the amount you paid to us for the specific Service that gave rise to the claim.

Information on our website is provided for general informational purposes only and does not constitute medical advice. Always consult with a licensed optometrist or other qualified healthcare professional for guidance regarding your specific vision and eye health needs.


10 Indemnification

You agree to indemnify, defend, and hold harmless South Shore Eye Associates and its officers, employees, agents, and representatives from and against any claims, liabilities, damages, losses, or expenses — including reasonable attorneys' fees — arising out of or in any way connected with:

  • Your use of our website or Services
  • Your violation of these Terms
  • Your provision of inaccurate or incomplete information to our practice
  • Your violation of any applicable law or third-party rights

11 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Bristol County, Massachusetts. You consent to personal jurisdiction in such courts.


12 Changes to These Terms

We reserve the right to update or amend these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our Services following any changes constitutes your acceptance of the revised Terms.
